Tax Credits Claim Complaints

If you are in the process of making a new claim or renewing your tax credits, call. You can make a complaint about any problems you are having with the claim. Make complaints about the eligibility rules if you think the criteria is unfair. Or call if you request a claim form but it doesn’t arrive within 2 weeks. You can complain if you are told you are eligible to receive a certain amount in tax credits and then this changes. Complain if you’re not getting the support you need on an application, especially for joint or backdated claims.

Tax Credits Decision Complaints

If you disagree with the tax credits that they are awarding you, call to make complaints about their decision. They will look over it and change it if something is actually wrong. If they don’t change it or something is still wrong, you must apply for a mandatory reconsideration. Call to get help with processing this complaint. You have to do it within 30 days of receiving your tax credits award notice, unless you had exceptional circumstances.

Tax Credits Overpayment Complaints

If you submit incorrect details, this will affect your tax credits award calculation. When your circumstances change, your tax credits award should also change when you report this. If you don’t, this might result in overpayments which you will have to pay back. Call to complain if overpayments occur as a result of an error by the Tax Office and it isn’t your fault. Tax Credits Delay Complaints

On average it can take 22 working days, or 4-5 weeks, to process a tax credits claim. You can backdate claims for up to 3 months before you submit the application. This might take longer to process. If you do not receive your tax credits award after 5 weeks, call to complain about delays. You should continue to contact the Tax Office the longer it takes from when you posted the claim form. Complain if a delay causes financial hardship.

Tax Credits Misconduct Complaints

There may not be a problem with your actual tax credits, but you can complain about the handling of your claim. If you believe that a Tax Office employee deliberately acted wrongly and negatively impacted your claim, then call to report this. You should call to report inappropriate behaviour such as discriminatory remarks. Report serious criminal misconduct such as fraud, corruption, assault, or violation of customer data protection law.

Tax Credits Compensation Complaints

When you complain to HMRC about anything, you can expect an apology, explanation, and correction of mistakes. If you are due a payment that you did not receive, they should pay this. However, you can also call to request compensation payments over your complaint. This could be dismissal of repayments, covering the cost of postage and phone calls, or payments for emotional or physical distress as a result of delays or errors.
